Negligent Entrustment in Texas

Car crash and personal injury

Have you or a loved one been injured in a Car Accident?

Sometimes people cause crashes using borrowed vehicles. You may have a claim against the driver for negligence, but insurance companies may refuse to cover accidents caused by drivers who are not listed as “additional insureds” under the vehicle owner’s insurance policy. This means that you may not recover with a simple negligence claim against the at-fault driver. You may need to hire a Texas attorney to assist with carefully navigating your possible claims so that you may recover from the vehicle owner’s insurance company.

In Texas, individuals hurt under these circumstances may have a claim against the vehicle owner if the owner 1) provided or allowed the vehicle or other equipment to be used by another person, 2) that person was unlicensed, incompetent, or reckless, 3) the owner knew or should have known the other driver was incompetent or reckless, and 4) the driver was negligent and caused the accident.

Negligent Entanglement

A driver who is unlicensed, incompetent, or reckless is someone who either doesn’t have a license, has a poor driving history such as prior accidents or traffic violations. When a driver’s history shows that they probably shouldn’t be allowed to drive a vehicle, the owner may be liable for negligent entrustment in Texas. Another example is allowing someone to drive who is drunk or on drugs.

Providing a vehicle means the owner permitted the driver to use the vehicle. Permission can be express, or it may be implied through routine or failing to object to a vehicle’s use, such as when a teenager routinely borrows a parent’s car. Vehicle owners may lend their vehicles to others, but negligent entrustment means you have loaned it to someone you shouldn’t have.

If you or someone you know has been injured in a crash and has questions about whether they may have a negligent entrustment claim..
